1. Acceptance of Terms

By downloading, installing, accessing, or using the VIBE AI Video Generator application ("VIBE," "the App") or visiting our website at vibeclips.ai ("the Website"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our services.

These Terms constitute a legally binding agreement between you and Rocket Digital Limited ("we," "us," or "our"), a company registered in Hong Kong.

3. Description of Service

VIBE is an AI video generator application that allows users to create videos from text prompts (text-to-video) and images (image-to-video) using artificial intelligence models. The App provides access to multiple AI video generation models and tools for content creation, editing, and export.

4. Eligibility

You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use VIBE. If you are under 18, you must have the consent of a parent or legal guardian. By using the App, you represent that you meet these eligibility requirements.

5. Account Registration

You may be required to create an account to access certain features. You agree to provide accurate and complete information, keep your login credentials secure, and notify us immediately of any unauthorized access to your account. You are responsible for all activity under your account.

6. Content Moderation and Safety

6.1 AI Safety Filters

VIBE employs automated content moderation systems and AI safety filters to prevent the generation of harmful, illegal, or inappropriate content. These filters operate on both input (text prompts and images) and output (generated videos) to detect and block prohibited content before it is created or delivered to users.

6.2 Prohibited Content

You may not use VIBE to generate, attempt to generate, or distribute content that:

Depicts or promotes child sexual abuse material (CSAM) or the exploitation of minors in any form.
Contains non-consensual intimate imagery, deepfakes, or sexually explicit content depicting real individuals without their consent.
Promotes terrorism, violent extremism, or provides instructions for carrying out acts of violence.
Constitutes hate speech, harassment, or content that targets individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics.
Contains graphic violence, gore, or content designed to shock or disturb.
Impersonates real individuals for the purposes of fraud, deception, defamation, or misinformation.
Infringes on copyrights, trademarks, or other intellectual property rights of third parties.
Promotes illegal activities, including but not limited to drug manufacturing, weapons production, or financial fraud.
Generates spam, phishing content, or malware distribution materials.
Creates misleading or deceptive content intended to manipulate public opinion, elections, or democratic processes.

6.3 Content Review and Enforcement

We reserve the right to review any content generated through the App. If our automated systems or manual review determine that content violates these Terms, we may:

Block the generation of the content before it is delivered.
Remove or disable access to previously generated content.
Issue a warning to your account.
Temporarily suspend your account and access to the service.
Permanently terminate your account without refund.
Report the activity to law enforcement authorities where required or appropriate.

6.4 Prompt and Input Monitoring

To maintain a safe platform, text prompts and image inputs may be analyzed by automated moderation systems before being processed by AI models. Prompts that are flagged as potentially violating our content policies may be rejected. Repeated attempts to circumvent safety filters or generate prohibited content will result in account suspension or termination.

6.5 Reporting Violations

If you encounter content generated through VIBE that you believe violates these Terms or applicable laws, please report it to vibe@rocketdigital.ai. We take all reports seriously and will investigate promptly.

6.6 No Guarantees on Filter Accuracy

While we make every effort to prevent harmful content, no automated moderation system is perfect. We do not guarantee that all prohibited content will be blocked, nor that all legitimate content will be allowed. If your content is incorrectly blocked, you may contact us for review.

7. User Content and Intellectual Property

7.1 Your Content

You retain ownership of the original text prompts and images you provide as input. For AI-generated video output created through the App, you are granted a license to use, share, and distribute the content for personal and commercial purposes, subject to these Terms and the limitations of your subscription plan.

7.2 License to Us

By using the App, you grant us a non-exclusive, worldwide, royalty-free license to process your inputs (text prompts and images) through our AI systems for the sole purpose of generating your requested video content. We do not claim ownership of your content.

7.3 AI Model Limitations

AI-generated content is created by third-party AI models (including but not limited to models from Google, OpenAI, Kling, and others). We do not guarantee that generated content will be free of errors, biases, or unintended similarities to existing works. You are responsible for reviewing generated content before use and ensuring it does not infringe on third-party rights.

7.4 Our Intellectual Property

The App, Website, brand name, logos, design, and all underlying technology are the intellectual property of Rocket Digital Limited. You may not copy, modify, distribute, reverse-engineer, or create derivative works from our software or services.

8. Subscriptions and Payments

8.1 Free and Paid Plans

VIBE offers both free and paid subscription plans. Free plans may include limitations on the number of generations, available AI models, video quality, and may include advertisements served through Google AdMob. Paid plans (Pro) unlock additional features, higher limits, and remove advertisements.

8.2 Billing

Subscriptions are billed through Apple App Store or Google Play Store. Payments are processed by RevenueCat on behalf of the respective app store. By subscribing, you agree to the payment terms of the app store through which you purchased the subscription.

8.3 Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can manage and cancel subscriptions through your device's app store settings.

8.4 Refunds

Refund requests are handled by the respective app store (Apple or Google) according to their refund policies. We do not process refunds directly. If your account is terminated for violation of these Terms, you are not entitled to a refund.

9. Acceptable Use

In addition to the content moderation rules in Section 6, you agree not to:

Use the App for any purpose that violates applicable laws or regulations.
Attempt to reverse-engineer, decompile, or extract the source code of the App or any AI models.
Use automated tools, bots, or scripts to access or interact with the App.
Interfere with or disrupt the App's infrastructure, servers, or networks.
Resell, sublicense, or redistribute access to the App or its features without our written consent.
Circumvent or attempt to bypass rate limits, safety filters, content moderation systems, or other technical restrictions.
Use the App to generate content in bulk for the purpose of spamming or flooding online platforms.
Create accounts using false identities or operate multiple accounts to evade enforcement actions.

10. Third-Party Services

The App integrates with third-party services including but not limited to Google Cloud, OpenAI, Firebase, Google Analytics, Vercel Analytics, Meta Pixel, AppsFlyer, Google AdMob, and RevenueCat. Your use of these services is governed by their respective terms and privacy policies. We are not responsible for the practices or policies of third-party services.

11. Disclaimers

11.1 Service Availability

We strive to provide reliable service but do not guarantee uninterrupted, error-free, or secure access to the App. The App is provided "as is" and "as available." We may modify, suspend, or discontinue any feature or the entire service at any time without prior notice.

11.2 AI-Generated Content

AI-generated videos may contain inaccuracies, artifacts, or unintended content. We do not guarantee the quality, accuracy, or suitability of generated content for any particular purpose. You use AI-generated content at your own risk and are solely responsible for how you use and distribute it.

11.3 No Professional Advice

Content generated by VIBE does not constitute professional advice of any kind. Do not rely on AI-generated content for legal, medical, financial, or other professional decisions.

12. Limitation of Liability

To the maximum extent permitted by law, Rocket Digital Limited and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the App.

Our total liability for any claim arising from or related to these Terms or the App shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or HKD 500, whichever is greater.

13. Indemnification

You agree to indemnify, defend, and hold harmless Rocket Digital Limited and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App, your content, your violation of these Terms, or your violation of any third-party rights.

14. Termination

We may suspend or terminate your account and access to the App at any time, with or without cause, and with or without notice. Grounds for termination include but are not limited to violation of these Terms, repeated content policy violations, suspected fraudulent activity, or extended periods of inactivity.

Upon termination, your right to use the App ceases immediately. Sections of these Terms that by their nature should survive termination (including Sections 6, 7, 11, 12, 13, and 16) will remain in effect.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our Website and within the App, and updating the "Last updated" date. Continued use of the App after changes constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App.

16. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any disputes arising from or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Hong Kong.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
